TERMS OF SERVICE

These Terms of Service (“Terms”) govern your access to and use of freedomfold.shop and any related products, features, content, and services offered by Freedom Fold.

Freedom Fold is operated by FreedomFold LLC, doing business as Freedom Fold (“Freedom Fold,” “we,” “us,” or “our”).

Please read these Terms carefully. By visiting the website, creating an account, submitting information, or purchasing a product, you agree to these Terms and the policies incorporated into them.

If you do not agree to these Terms, do not use the website or purchase our products.

1. RELATED POLICIES

The following policies are incorporated into these Terms:

  • Privacy Policy

  • Shipping Policy

  • Returns, Refunds, and Cancellation Policy

  • Any additional policy or product-specific term displayed on the website

When a specific policy directly addresses a transaction or issue, that specific policy will control over a more general provision in these Terms.

Nothing in these Terms limits a right or remedy that cannot legally be waived.

2. ELIGIBILITY

You must be at least the age of majority in your state, province, or country of residence to place an order.

By using the website or placing an order, you represent that:

Our store is hosted through Shopify, which provides the e-commerce platform used to display products and process transactions.

Shopify and other service providers may process information as described in our Privacy Policy and their own applicable terms and privacy notices.

We may modify, suspend, restrict, or discontinue all or part of the website at any time. When reasonably practical, we may provide notice of material changes affecting existing customer orders.

4. PRODUCTS AND AVAILABILITY

Freedom Fold sells flags and related products, many of which are printed, produced, or fulfilled after an order is placed.

Products may:

  • Be available only online

  • Be made or printed to order

  • Be produced or fulfilled by third-party partners

  • Have limited availability

  • Vary slightly from website images because of screen settings, manufacturing processes, material characteristics, placement, cropping, or production tolerances

We make reasonable efforts to display products, colors, dimensions, designs, specifications, and descriptions accurately. However, the color and appearance shown on a device may differ slightly from the physical product.

Minor variations that do not materially change the product are not necessarily defects.

We may limit sales by product, quantity, person, household, geographic region, jurisdiction, payment method, or order when reasonably necessary to prevent fraud, protect inventory, comply with law, or manage fulfillment.

We may discontinue a product without notice. Product offers are void where prohibited.

5. PRODUCT USE AND CARE

Customers are responsible for reviewing product descriptions, dimensions, materials, intended uses, installation guidance, and care instructions before purchasing or using a product.

Outdoor products may experience fading, wear, fraying, discoloration, or deterioration over time because of sunlight, wind, moisture, storms, temperature, installation method, and other environmental conditions.

Unless expressly covered by a written product warranty, ordinary weathering and wear are not manufacturing defects.

Customers are responsible for:

  • Selecting an appropriate product and size

  • Installing and displaying products safely

  • Using suitable mounting hardware

  • Following care instructions

  • Removing or securing products during severe weather when appropriate

  • Complying with applicable property, campground, homeowners’ association, municipal, or other display rules

6. ORDERS

Submitting an order is an offer to purchase. An automated order confirmation acknowledges receipt but does not necessarily constitute final acceptance.

We may accept, reject, limit, hold, or cancel an order when reasonably necessary, including when:

  • A product is unavailable

  • Payment cannot be authorized

  • Order information is incomplete or inaccurate

  • A pricing, description, inventory, or system error occurred

  • We reasonably suspect fraud, unauthorized activity, resale, abuse, or policy violations

  • Fulfilling the order would violate applicable law, carrier restrictions, platform rules, or third-party rights

  • The order cannot reasonably be fulfilled

If we cancel an order after collecting payment, we will refund the canceled amount to the original payment method.

We may contact you using the email address or telephone number submitted with the order when additional information is needed.

7. PRICING AND PAYMENT

Prices are displayed in the currency identified at checkout and may change without notice.

The price charged is ordinarily the price displayed when the order is submitted, subject to correction of obvious errors.

Taxes, shipping charges, customs duties, payment fees, and other charges may be added where applicable and disclosed during checkout or under our published policies.

You agree to provide accurate billing and payment information and to promptly update information needed to complete the transaction.

You represent that:

  • You are authorized to use the payment method

  • The payment information is accurate

  • Charges incurred through your account may be submitted to the payment provider

  • You are responsible for amounts properly charged under the order

If an obvious pricing or system error occurs, we may contact you to approve the corrected price or cancel the affected order and refund amounts collected for it.

8. ORDER CANCELLATIONS, RETURNS, AND REFUNDS

Cancellations, modifications, returns, replacements, exchanges, and refunds are governed by our Returns, Refunds, and Cancellation Policy.

Because many products are made or printed to order, cancellation or modification requests are not guaranteed after production or fulfillment begins.

Customers must follow the authorization and return instructions provided by Freedom Fold. Products sent to an unauthorized address may not be received or refunded.

Nothing in these Terms eliminates any refund or cancellation right required by applicable law.

9. SHIPPING AND DELIVERY

Shipping and delivery are governed by our Shipping Policy.

Delivery dates are estimates unless expressly stated otherwise. Carrier delays, weather, customs processing, incorrect addresses, and other events may affect delivery.

Customers are responsible for providing a complete and accurate shipping address and for monitoring tracking information.

Risk of loss and legal title transfer as provided by applicable law and the shipping terms associated with the order.

If we cannot ship within an advertised or otherwise legally required period, we will provide any notice, cancellation opportunity, or refund required by applicable law.

10. INTERNATIONAL ORDERS

International orders may be subject to:

  • Import duties

  • Taxes

  • Customs assessments

  • Brokerage fees

  • Carrier charges

  • Product restrictions

  • Delays or inspections

Unless checkout expressly states otherwise, the recipient is responsible for these charges and for determining whether the product may lawfully be imported.

We are not responsible for delays caused by customs authorities. Returned or refused international shipments are handled under our Returns, Refunds, and Cancellation Policy.

11. CUSTOMER ACCOUNTS

You may be permitted to create a customer account.

You are responsible for:

  • Maintaining the confidentiality of login credentials

  • Restricting access to your account and device

  • Providing accurate account information

  • Notifying us promptly of suspected unauthorized activity

You are responsible for activity occurring through your account to the extent permitted by law.

We may suspend or terminate an account reasonably believed to be involved in fraud, abuse, unauthorized access, unlawful activity, or violations of these Terms.

12. CUSTOMER-SUBMITTED MATERIALS

You may be permitted to submit reviews, photographs, comments, feedback, custom text, artwork, designs, instructions, or other materials (“Customer Content”).

You retain ownership of Customer Content you lawfully own.

By submitting Customer Content for an order, review, promotion, or website feature, you grant Freedom Fold a nonexclusive, worldwide, royalty-free license to use, reproduce, modify, format, display, transmit, and process that content as reasonably necessary to:

  • Fulfill and support your order

  • Manufacture or customize a product

  • Operate and improve the website

  • Respond to your communication

  • Display a review or submission you chose to publish

  • Promote Freedom Fold when you have authorized promotional use

  • Maintain records or comply with legal obligations

This license continues for as long as reasonably necessary for those purposes. Publicly posted content may remain in backups or records after deletion, subject to applicable law.

You represent that Customer Content:

  • Is accurate when presented as factual

  • Is owned by you or used with proper permission

  • Does not infringe copyrights, trademarks, privacy rights, publicity rights, or other rights

  • Is not defamatory, fraudulent, threatening, abusive, obscene, or unlawful

  • Does not contain malware or harmful code

  • Does not misrepresent your identity or relationship with another person

We may remove or decline content that violates these Terms or applicable law.

We do not prohibit or penalize honest reviews or opinions merely because they are negative.

13. CUSTOM DESIGNS AND INTELLECTUAL-PROPERTY CLEARANCE

When submitting text, artwork, photographs, logos, names, slogans, or designs for a customized product, you represent that you have all rights and permissions necessary for Freedom Fold and its fulfillment partners to reproduce and use those materials.

We may refuse or cancel custom work that we reasonably believe:

  • Infringes intellectual-property or privacy rights

  • Is illegal, fraudulent, threatening, or defamatory

  • Promotes unlawful violence or criminal conduct

  • Violates the policies of Shopify, a payment provider, or a fulfillment partner

  • Creates unreasonable legal or operational risk

You are responsible for claims resulting from materials you submitted without the required rights or authorization, subject to applicable law.

14. FREEDOM FOLD INTELLECTUAL PROPERTY

The website and its content—including the Freedom Fold name, logos, graphics, designs, photographs, product images, copy, page layouts, videos, and other original materials—are owned by or licensed to Freedom Fold and are protected by applicable intellectual-property laws.

Except as expressly permitted, you may not:

  • Copy, reproduce, republish, distribute, or commercially exploit website content

  • Use Freedom Fold branding in a way that suggests sponsorship or affiliation

  • Remove copyright, trademark, or ownership notices

  • Scrape, download, or systematically collect website content

  • Create unauthorized derivative products from Freedom Fold designs

  • Use product images or descriptions to market competing or counterfeit products

You may use the website for ordinary personal shopping and noncommercial purposes.

No license or ownership right is granted except as expressly stated.

15. PROHIBITED USES

You may not use the website or Services to:

  • Violate any applicable law or regulation

  • Infringe another party’s rights

  • Submit fraudulent, inaccurate, or misleading information

  • Conduct unauthorized transactions

This provision does not eliminate responsibility that applicable law places directly on Freedom Fold for its own actions or obligations.

17. PRIVACY

Our collection, use, retention, and disclosure of personal information are described in our Privacy Policy.

By using the website, you acknowledge that personal information may be processed by Shopify and other service providers necessary to operate the store, process payments, fulfill orders, deliver products, prevent fraud, provide customer support, and conduct permitted marketing.

18. WEBSITE INFORMATION AND ERRORS

We make reasonable efforts to maintain accurate website information. Nevertheless, typographical errors, technical errors, outdated information, or omissions may occasionally occur.

We may correct errors, update information, or cancel affected orders when reasonably necessary.

Nothing in this section permits us to retain payment for a canceled order or avoid obligations imposed by applicable consumer-protection law.

Historical, editorial, educational, or general website content may not reflect the most current information and should not be treated as professional legal, financial, medical, or other specialized advice.

19. DISCLAIMER OF WARRANTIES

To the maximum extent permitted by law, the website and its general content are provided on an “as available” basis.

We do not guarantee that:

  • The website will always be uninterrupted or error-free

  • Every defect will be corrected immediately

  • The website will be free from all harmful components

  • Website content will satisfy every individual purpose

To the maximum extent permitted by law, Freedom Fold’s total liability arising from a particular order will not exceed the amount paid to Freedom Fold for the product giving rise to the claim.

These limitations do not apply to:

  • Liability that cannot legally be limited

  • Fraud or intentional misconduct

  • Gross negligence where limitation is prohibited

  • Personal injury or property damage where applicable law prohibits limitation

  • Statutory consumer rights that cannot be waived

Some jurisdictions do not allow certain exclusions or limitations, so some provisions may not apply to you.

21. INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold Freedom Fold and its owners, employees, contractors, and service providers harmless from third-party claims, damages, liabilities, and reasonable legal expenses arising from:

  • Customer Content you submitted

  • Your infringement of another party’s rights

  • Your unlawful use of the website

  • Fraudulent or unauthorized conduct by you

  • Your material violation of these Terms

This obligation does not apply to claims caused by Freedom Fold’s own unlawful conduct, negligence, or breach of duty to the extent prohibited by law.

22. FORCE MAJEURE

Freedom Fold is not responsible for delays or failure to perform caused by circumstances beyond its reasonable control, including:

  • Severe weather

  • Natural disasters

  • Fire

  • War or civil unrest

  • Governmental action

  • Labor disruptions

  • Carrier interruption

  • Customs delays

  • Utility, internet, or platform outages

  • Cyberattacks

  • Supplier or production disruption

  • Public-health emergencies

This section does not eliminate any legally required cancellation, notice, shipment, or refund obligation.

23. SUSPENSION AND TERMINATION

These Terms remain effective while you use the website.

You may stop using the website at any time.

We may suspend or terminate access when we reasonably believe you have:

  • Violated these Terms

  • Engaged in fraud or abuse

  • Created legal, security, or operational risk

  • Failed to pay amounts properly due

  • Used the website unlawfully

Rights and obligations that arose before termination remain enforceable. Provisions that logically should survive—including payment, intellectual property, liability, indemnification, dispute, and record keeping provisions—will survive.

24. GOVERNING LAW

These Terms and transactions with Freedom Fold are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except when another jurisdiction’s nonwaivable consumer-protection laws apply.

Any legal proceeding must be brought in a court with lawful jurisdiction over the dispute.

Nothing in this section prevents a customer from asserting rights in another forum when applicable law requires that forum to remain available.

25. SEVERABILITY

If a provision of these Terms is found unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted or severed when necessary.

The remaining provisions will remain effective.

26. NO WAIVER

Failure to enforce a provision does not waive the right to enforce it later.

A waiver is effective only when made in writing by an authorized representative of Freedom Fold and applies only to the specific matter identified.

27. ASSIGNMENT

You may not assign or transfer your rights or obligations under these Terms without our written consent.

Freedom Fold may assign these Terms in connection with a merger, acquisition, financing, reorganization, sale of assets, change of control, or transfer of the business, subject to applicable law.

28. ELECTRONIC COMMUNICATIONS

You agree that communications, notices, disclosures, order confirmations, and records may be provided electronically through the website or by email.

Electronic communications satisfy any legal requirement that a communication be in writing to the extent permitted by law.

You are responsible for providing and maintaining a current email address.

29. NO THIRD-PARTY BENEFICIARIES

Except where expressly stated, these Terms do not create enforceable rights for anyone other than you and Freedom Fold.

30. ENTIRE AGREEMENT

These Terms and the policies incorporated into them constitute the entire agreement between you and Freedom Fold regarding use of the website and purchases made through it.

They supersede prior communications concerning the same subject, but they do not replace a separate written agreement expressly signed by an authorized representative of Freedom Fold.

31. CHANGES TO THESE TERMS

We may update these Terms to reflect changes in our business, products, technology, practices, or legal obligations.

The current version will be posted on this page with a revised “Last updated” date.

Changes ordinarily apply prospectively. Terms in effect when an order was placed will continue to govern that transaction unless applicable law requires otherwise or the parties agree to a change.

Continued use of the website after revised Terms become effective constitutes acceptance of the revised Terms.
